What does the law say in Marseille in 2026?

French legislation is evolving, but the government's stance remains strict. Here is what you absolutely must know to avoid trouble.

Recreational Cannabis

Status: Prohibited (Criminal Offense)

Smoking or possessing cannabis ("weed", "hash") remains an offense under the Public Health Code.

  • Fixed Fine: €200 (reduced to €150). A Senate bill plans to increase it to €500.
  • Driving (Zero Tolerance): Positive saliva test = up to 3 years in prison, €9000 fine and withdrawal of 6 points (Law tightened in 2025/2026).

CBD Flowers & Derivatives

Status: Legal under conditions

Marseille's CBD shops are legal, but the framework has become more rigid this year.

  • THC Level: Must remain strictly below 0.3% in finished products.
  • Edibles (Novel Food): Since May 15, 2026, the DGAL strictly targets oils and gummies without European authorization.

Medical Cannabis

Status: Transition & Waiting

The shift to a permanent framework (common law) has been delayed, penalizing new patients.

  • Current Patients: Only those included before March 2024 maintain their prescription. No new patients are admitted.
  • Future: A key decree is presented to the Council of State by end of June 2026. General access is hoped for 2027.
